1. About these terms
- 1.1These terms apply to every booking of Chris Waters as an HGV Class 1 or Class 2 driver through NVServices, trading as NVDriverHire (“I”, “me”).
- 1.2“You” means the agency or company making the booking. If you book on behalf of an end client, you remain responsible for these terms and for passing on any that affect the end client.
- 1.3By requesting a booking, whether through the booking page, by email or by phone, you agree to these terms. They apply in place of any other terms unless we both agree otherwise in writing.
2. Bookings
- 2.1A booking request is provisional until I confirm it by email. Requested dates are held for you while I review the request.
- 2.2I may decline a request, for example if the dates are no longer available or the work falls outside section 4. If I decline, I’ll tell you why by email.
- 2.3Please give accurate details of the site, start time, vehicle and type of work. If the job on the day is materially different from what was booked, I may decline it, and the minimum charge in section 3 still applies.
3. Rates and hours
- 3.1My hourly rates are:
| Shift | Rate |
|---|---|
| Days, Monday–Friday | £30.30 / hr |
| Days, Saturday–Sunday | £40.83 / hr |
| Nights, Monday–Friday | £35.50 / hr |
| Nights, Saturday–Sunday | £46.12 / hr |
- 3.2The rate for a shift is set by the day the shift starts. Shifts starting on a bank holiday are charged at time and a half: the normal rate for that day and shift plus half again.
- 3.3The rates in force on the day you request a booking apply to that booking, even if my rates change later.
- 3.4A minimum of 10 hours is payable per shift, even if I’m released earlier.
- 3.5Hours are counted from the booked start time, or from when I actually start if that is earlier, until I’m released from duty. This includes breaks, which are paid, and any waiting time not caused by me. Time over 10 hours is charged at the same hourly rate, rounded up to the nearest 15 minutes.
- 3.6I’m not currently registered for VAT, so no VAT is charged. If that changes, I’ll give you notice and VAT will be added at the current rate.
4. Type of work
- 4.1No nights out and no tramping. Every shift ends with me back at the starting depot or base, not in the cab.
- 4.2I work within the GB drivers’ hours rules, the Road Transport (Working Time) Regulations 2005 and tachograph rules at all times. I won’t be asked to break them, and I may stop work when I reach a legal limit.
- 4.3I bring my own driver CPC card, digital tachograph card and standard PPE (hi-vis, safety boots and gloves). Any other PPE or equipment a site needs must be provided by you or the end client.
5. Cancellations
- 5.1You can cancel a confirmed shift free of charge if you tell me at least 24 hours before its start time.
- 5.2If you cancel with less than 24 hours’ notice, or I arrive and there is no work, the 10-hour minimum charge for that shift is payable.
- 5.3If I can’t work a confirmed shift because of illness or an emergency, I’ll tell you as soon as I can. You won’t be charged for that shift, but I’m not liable for any other costs or losses the cancellation causes.
- 5.4Please cancel by phone (07876 308681) and confirm by email, so there’s a written record.
6. Vehicles, sites and safety
- 6.1You, or the end client, must provide a vehicle that is roadworthy, legally plated, taxed and insured for me to drive, with goods-in-transit cover for the load.
- 6.2I carry out a walkaround check before driving and report any defects. I may refuse to drive a vehicle I reasonably believe is unsafe or illegal. If I refuse and no suitable vehicle is provided, the minimum charge still applies.
- 6.3You must make sure loads are within legal weights, and loaded and secured safely when the loading is not done by me. You must also provide any site induction and safe-system-of-work information I need.
7. Fines and penalties
- 7.1I’m responsible for fines and penalty points caused by my own driving, such as speeding.
- 7.2You’re responsible for fines, penalty charge notices, congestion or clean-air charges, tolls and parking charges that result from the vehicle’s condition, the load, the route or instructions given by you or the end client.
8. Liability
- 8.1Damage to the vehicle, load or third-party property while I’m driving must be claimed on the vehicle owner’s or operator’s insurance. I’m only liable for such damage if it is caused by my wilful misconduct or gross negligence.
- 8.2I’m not liable for indirect or consequential losses, including lost profit, lost contracts or delays to deliveries.
- 8.3My total liability for any booking is limited to the amount payable to me for that booking.
- 8.4Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
9. Timesheets and payment
- 9.1Hours are recorded on a timesheet, which you or the end client sign at the end of each shift or week. A signed timesheet is final unless an error is reported within 2 working days.
- 9.2I invoice weekly. Invoices are due for payment within 7 days of the invoice date, by bank transfer to the account shown on the invoice.
- 9.3On late payments I may claim interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998, and may decline new bookings until the account is paid.
10. Self-employed status
- 10.1I’m self-employed, working through NVServices. I’m not an employee or worker of you or of the end client, and nothing in a booking creates an employment relationship.
- 10.2I’m responsible for my own income tax and National Insurance. You don’t pay employer’s National Insurance, holiday pay, pension contributions or Driver CPC training costs for me.
- 10.3I’m free to work for other agencies and clients.
11. Confidentiality
- 11.1Rate discretion assured: I won’t share the rates you pay, or your clients’ details, with anyone else.
- 11.2I keep confidential any business information I learn while working on a client’s site.
12. Your information
- 12.1Details you give when booking (names, email addresses, phone numbers and site addresses) are used only to manage bookings, keep you updated and send invoices.
- 12.2They’re stored in my Google account (Calendar, Gmail and the booking system) and are not sold or shared for marketing. I keep booking records for as long as needed for tax purposes, normally 6 years.
- 12.3You can ask to see, correct or delete your information by emailing chris@nvdriverhire.co.uk, as far as tax and accounting rules allow.
13. General
- 13.1I may update these terms. Changes apply to bookings requested after the date shown at the top of this page, not to bookings already confirmed.
- 13.2If any part of these terms is found to be unenforceable, the rest still applies.
- 13.3These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
